1. Acceptance of Terms

By accessing and using Kitabey ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Platform. Kitabey reserves the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Platform Description

Kitabey is an online classified advertisement platform that enables users to post listings for educational materials including but not limited to books, notes, PDFs, and ebooks. Kitabey acts solely as an intermediary platform that connects buyers and sellers. We do not own, sell, resell, furnish, provide, manage, or control any listings or the educational materials listed on our Platform.

3. User Responsibilities

As a user of Kitabey, you agree to:

  • Provide accurate and truthful information in your listings and profile
  • Not post any illegal, fraudulent, or misleading content
  • Not infringe upon any intellectual property rights or copyrights
  • Conduct all transactions at your own risk and discretion
  • Verify the authenticity and quality of items before completing any transaction
  • Not use the Platform for any unlawful purposes
  • Be at least 18 years of age or have parental consent to use the Platform

4. No Responsibility for Transactions

IMPORTANT: Kitabey is purely an advertisement and listing platform. We do not participate in, mediate, or guarantee any transactions between users. All transactions, including payment, delivery, and quality of goods, are solely between the buyer and seller. Kitabey bears no responsibility for:

  • The quality, safety, legality, or availability of items listed
  • The truth or accuracy of listings or user content
  • The ability of sellers to sell items or buyers to pay for items
  • Any disputes between users
  • Any loss, damage, or fraud arising from transactions
  • Non-delivery or delayed delivery of items
  • Payment disputes or refund claims

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. KITABEY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITABEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY TRANSACTIONS CONDUCTED THROUGH IT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE PLATFORM.

7. User Content

Users retain ownership of content they post on Kitabey. By posting content, you grant Kitabey a non-exclusive, royalty-free license to use, display, and distribute your content on the Platform. You are solely responsible for the content you post and must ensure it does not violate any laws or third-party rights.

8. Intellectual Property

Users must ensure they have the right to sell or distribute any educational materials listed on the Platform. Kitabey is not responsible for any copyright infringement by users. We will cooperate with copyright holders to remove infringing content upon proper notice.

9. Account Termination

Kitabey reserves the right to suspend or terminate user accounts at our sole discretion, without prior notice, for any violation of these Terms of Service or for any other reason we deem appropriate. Users may also delete their accounts at any time.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kitabey, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in India.
